Terms of Service

Last updated: October 5, 2026

Welcome to WhaleHerald ("WhaleHerald", "we", "us"). These Terms of Service ("Terms") govern your use of whaleherald.com and everything on it — the WhaleHerald companion, Ask the Whale, the lessons, market data, practice trading, alerts and related features (together, the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. Education, not financial advice

WhaleHerald is an educational and informational service. Nothing on the Service — lessons, videos, quizzes, market data, news, whale-flow signals and their A/B/C grades, AI answers, calculators or any other content — is investment, financial, legal or tax advice, or a recommendation to buy, sell or hold any security, option or other asset. WhaleHerald is not a broker-dealer, investment adviser or financial planner and does not know your personal financial situation. You alone are responsible for your investment decisions. Consider talking to a licensed professional before you invest.

2. Paper money only

WhaleHerald's trading features use simulated ("paper") money. WhaleHerald never places real trades, never holds or moves your money and does not connect to your brokerage account. Paper results do not include real-world costs such as commissions, fees, slippage, taxes or partial fills, and are not a guarantee of how real trading would turn out.

3. Market data and signals

Market data, news, social posts and calendars come from third-party sources. Stock quotes may be real-time; options data is typically delayed by about 15 minutes; some data updates only once a day. Data can be delayed, incomplete or wrong, and is provided "as is" without warranty. Whale-flow signals are built from public market data and are clues, not predictions — large trades can be hedges, spreads or closing trades. Past performance, including any signal track record we show, does not guarantee future results.

4. Ask the Whale (AI)

Ask the Whale uses artificial intelligence. AI answers can be incomplete, out of date or wrong, even when they sound confident. Always verify important information yourself. Don't enter passwords, account numbers, government IDs or other sensitive personal information into the chat.

5. Your account

You must be at least 18 years old to use the Service. Give accurate information, keep your password safe, and don't share your account. You're responsible for activity on your account. Tell us promptly if you think your account has been compromised. You can download your data or delete your account at any time from your account menu.

6. Acceptable use

Don't: copy, scrape or bulk-download the Service or its data; use bots or automated access (except ordinary search-engine crawling of public pages); try to bypass usage limits or security; misuse Ask the Whale (for example to generate spam or harmful content); reverse-engineer the Service; resell or redistribute courses, videos, data or signals; or use the Service for anything unlawful, including market manipulation. We may limit, suspend or close accounts that break these rules.

7. Plans, payments and cancellations

During the beta, the Service is free. When paid plans launch, prices will be shown before you buy. Paid plans are subscriptions billed in advance through our payment processor (PayPal) and renew automatically until you cancel. You can cancel at any time — on the Pricing page or in your PayPal account; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where the law requires otherwise, payments are non-refundable. We'll give you notice before changing the price of an existing subscription.

8. Our content

The courses, videos, quizzes, text, designs, logos and software on the Service belong to WhaleHerald or its licensors. We give you a personal, non-transferable, non-commercial licence to use them through the Service while you have an account. Third-party content (such as news headlines and posts from X accounts) belongs to its owners; we don't endorse it.

9. Risk disclosure

Investing and trading involve risk, including the possible loss of all the money you invest. Options are complex and risky: buyers can lose the entire premium quickly, sellers of uncovered options can face losses far larger than the premium they receive, and short-dated (0DTE) options can go to zero within minutes. Leverage, margin and day trading magnify losses. Before trading options with a real broker, read the "Characteristics and Risks of Standardized Options" published by The Options Clearing Corporation, and make sure your broker has approved you for the strategy.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, availability, fitness for a particular purpose and non-infringement. To the fullest extent the law allows, WhaleHerald will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any trading or investment losses, lost profits or lost data, arising from your use of (or inability to use) the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if you haven't paid us anything. Some places don't allow these limits, so they may not fully apply to you.

11. Changes and termination

We may change, suspend or discontinue features at any time, especially during the beta. We may update these Terms; if the changes are material we'll let you know on the site or by email before they take effect. Continuing to use the Service after changes take effect means you accept them. You can stop using the Service and delete your account at any time.

12. Governing law

These Terms are governed by the laws of the place where WhaleHerald's operator is established, except where the law of the place you live gives you rights that can't be waived.

13. Contact

Questions about these Terms: We're setting up a dedicated contact address — it will be published here shortly.
